Vanguard Healthcare Sued for Substandard Care

Nursing home abuse attorneys are seeing an increase in cases where nursing homes provide non-existent or substandard care while billing Medicare and insurance companies for services they are not providing.

Most recently, the United States Department of Justice has filed suit against Vanguard Healthcare, LLC based in Brentwood, Tennessee. The government has filed a False Claims Act lawsuit alleging that the company deliberately submitted false claims to Medicare and TennCare for services they did not provide to patients. Currently, the company operates 6 facilities with 800 beds.

In their suit, the government claims that from January 2010 to December 2015, Vanguard Healthcare's six nursing homes failed to adhere to standard procedures regarding infection control, failed to provide prescribed medication, ignored physicians medical advice, and did not provide proper pain management care to residents. The government also alleges that the facilities provided excessive psychotropic medications to patients and intentionally used unnecessary physical restraint of residents.

It is not the first time that Vanguard has found itself afoul with the law. In 2011, the company settled a whistleblower lawsuit stemming from illegally double billing Medicare and Medicaid for feeding tubes. Indeed, the company has a history of shady practices that put patient health and safety at considerable risk all in the name of corporate profits.

The government's lawsuit may be enough to shutter the doors of the company forever. In May 2016, the company filed for Chapter 11 bankruptcy protection. Should the government find the company guilty of the charges currently levied against it, there will be enough leverage to shut them down once and for all. Permanent closure of the facilities would protect future patients and their families from suffering at the hands of a nursing home care provider with a track record of elder abuse and neglect.

Patients and family members who experience the types of neglectful "care" provided by facilities within the Vanguard Healthcare network should meet with a nursing home abuse attorney. The types of nursing home neglect and abuse perpetrated by the company may be more extensive than is currently known. Moreover, residents who suffered substandard care and other forms of maltreatment while under the care of Vanguard Healthcare's staff may be entitled to compensation for the pain and suffering and any subsequent injuries that resulted from their treatment within the companies Tennessee nursing homes.
