Tolling the Statute of Limitations in Wrongful Death Cases

graveyard-1417871_1280-240x161.jpgUnder Tennessee law, family members of a deceased person who dies due to wrongful actions of another person are allowed to file wrongful death claims and sue for damages. Typically, claims must be filed within the statute of limitations, but under certain circumstances the statute of limitations period can be "tolled" or put on hold.

Federal Regulators Look to Limit Commercial Truck Speeds

truck-1499377_1280-Pixabay-240x161.jpgThe Federal Motor Carrier Safety Administration and the National Highway Traffic Safety Administration have identified the speed of large commercial trucks and buses as a large contributor to fatal truck-involved crashes in the U.S. The size and weight of these large vehicles make it much more difficult for them to stop. The stopping distances for commercial trucks and buses are much higher than are those for smaller vehicles, and the stopping distances increase even further when the vehicles are traveling at faster speeds. In order to try to reduce the average 1,115 deaths that are caused by large trucks each year, the two agencies have proposed the mandatory installation of speed limiting devices on large trucks and buses. A trucking accident attorney often represents clients injured by trucks driving too fast or carrying too much weight.

Improperly Loaded Trucks Put Tennessee Drivers at Risk

semi-trailers-534575_1280-Pixabay-240x161.jpgWith such massive size and weight, semi trucks are already dangerous to maneuver, but when these monstrous vehicles are overloaded or loaded improperly the results can be catastrophic. Although the Federal Motor Carrier Safety Administration (FMCSA) provides a detailed handbook that describes the proper methods for loading a semi truck to drivers, loaders, trucking companies and inspectors, these regulations are all too often followed incorrectly, or entirely ignored. Unfortunately, these actions put unsuspecting motorists at risk for serious injuries or even death.
